CEF takes your privacy seriously. This Privacy Policy describes how CEF collects, uses, discloses, and retains personal information that visitors voluntarily submit through the Site, and the rights and choices available to visitors located in the United States. Capitalized terms not defined here have the meaning given to them in our Terms of Service.
1. Scope and Geographic Limitation
This Privacy Policy applies to personal information that CEF collects through https://www.cooperativeenergyfutures.com/ and the CEF company page on the Solar Amps portal at https://www.solaramps.com/company/CEF (together, the “Site”). The Site is intended for visitors located in the United States, including California. CEF does not direct the Site to, and does not knowingly collect personal information from, individuals located outside the United States. If you are located outside the United States, please do not submit your email address or phone number through the Site.
2. Key Terms
“Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.
“Sensitive Personal Information” has the meaning given to that term under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”).
3. Personal Information We Collect
Depending on how you interact with the Site, CEF may collect the following limited categories of Personal Information:
Identifiers — the email address and, if you choose to provide it, the mobile phone number you voluntarily submit through the Site (including when you opt in to receive text messages), and any name or identifier you choose to provide together with your contact information.
Internet and network activity information — limited information generated automatically by your device and browser when you access the Site, including IP address, browser type, operating system, and pages visited, all of which are collected through standard server logs maintained by our website hosting provider.
CEF does not collect Sensitive Personal Information through the Site. CEF does not use cookies, pixels, or third-party analytics on the Site.
4. How We Collect Personal Information
CEF collects Personal Information from the following sources:
Directly from you, when you voluntarily submit your email address or mobile phone number through the contact form on the Site or when you opt in to receive text messages from CEF;
Automatically through standard server logs, when your device or browser accesses the Site; and
From the email-service provider CEF uses to manage its contact list and email delivery.
From the text-messaging service provider CEF uses to manage text message opt-ins, opt-outs, and delivery.
5. How and Why We Use Your Personal Information
CEF uses Personal Information for the following purposes:
To operate, secure, and improve the Site;
To contact you at the email address you submitted through the Site, consistent with your request;
To send you text (SMS/MMS) messages — including membership, account, and service updates and, where you have provided the required consent, marketing messages — if you have opted in to receive them (you may opt out at any time as described below);
To send marketing communications about CEF where permitted by law (you may opt out at any time as described below);
To detect, prevent, and respond to fraud, abuse, security incidents, and violations of our policies;
To comply with legal obligations and enforce our agreements; and
For other purposes you consent to or direct.
6. Marketing, Text Messages, and Your Choices
CEF may send you marketing emails about CEF and its activities. You may opt out at any time by (a) using the “unsubscribe” link in any marketing email or (b) contacting us at info@cooperativeenergyfutures.com. CEF will honor opt-out requests within the time required by law. Service-related communications, such as responses to inquiries you submit, are not considered marketing and may continue regardless of your marketing preferences. CEF complies with the federal CAN-SPAM Act with respect to its commercial email communications.
Text messages. If you opt in to CEF’s text message program, CEF may send you recurring informational and marketing text (SMS/MMS) messages at the mobile phone number you provided, consistent with the consent you gave at opt-in. Message frequency varies, and message and data rates may apply. You may opt out of text messages at any time by replying STOP (or another recognized opt-out keyword) to any text message from CEF or by contacting us at info@cooperativeenergyfutures.com; after opting out, you may receive a single message confirming your opt-out. Reply HELP to any text message for assistance. CEF obtains and honors consent for text messages in accordance with the Telephone Consumer Protection Act (TCPA) and applicable state law.
No mobile information sharing. No mobile telephone numbers or text message opt-in data or consent will be shared with or sold to third parties or affiliates for their own marketing or promotional purposes. Text message opt-in data and consent will be shared only with service providers acting on CEF’s behalf for the purpose of operating the text message program, or as required by law.
7. Who We Share Your Personal Information With
CEF may share Personal Information with the following categories of recipients:
Google LLC (Gmail) — contact list management and email delivery;
[WEBSITE HOSTING PROVIDER] — Site hosting and standard server-log infrastructure (CEF’s domain is registered through Encirca; hosting provider to be confirmed);
[TEXT MESSAGE SERVICE PROVIDER] — text message opt-in/opt-out management and message delivery;
Law enforcement, regulators, and other authorities, where CEF is required by law or where disclosure is reasonably necessary to protect the rights, property, or safety of CEF, its visitors, or the public; and
A successor entity in connection with a merger, acquisition, financing, reorganization, or sale of all or a portion of CEF’s business or assets, subject to appropriate confidentiality protections.
CEF requires its service providers to use Personal Information only to provide services to CEF and to apply appropriate security and confidentiality measures. CEF does not sell your Personal Information, and CEF does not share your Personal Information for cross-context behavioral advertising as those terms are defined under the CCPA.
8. How Long We Keep Personal Information
CEF retains Personal Information for as long as necessary to provide the services described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When CEF no longer needs Personal Information, CEF will delete, aggregate, or de-identify it in a manner consistent with applicable law. Specific retention periods may vary by data category and are maintained in our internal retention schedule.
9. California Consumers: Your Rights Under the CCPA
If you are a California resident, the CCPA gives you the following rights with respect to your Personal Information, subject to applicable exceptions:
Right to know: to request disclosure of the categories and specific pieces of Personal Information CEF has collected about you, the categories of sources, the purposes of collection, and the categories of third parties to whom CEF has disclosed Personal Information.
Right to delete: to request deletion of Personal Information CEF has collected from you, subject to legal exceptions.
Right to correct: to request correction of inaccurate Personal Information CEF maintains about you.
Right to opt out of sale or sharing: to direct CEF not to sell or share your Personal Information for cross-context behavioral advertising. As stated above, CEF does not sell or share Personal Information for cross-context behavioral advertising.
Right to limit use of Sensitive Personal Information: to direct CEF to use Sensitive Personal Information only for limited purposes permitted by law. As stated above, CEF does not collect Sensitive Personal Information through the Site.
Right to non-discrimination: you will not receive discriminatory treatment for exercising your rights under the CCPA.
To exercise these rights, contact CEF at info@cooperativeenergyfutures.com. CEF will verify your request before responding, which may include asking you to confirm the email address you submitted through the Site or to provide other information reasonably necessary to verify your identity. You may also designate an authorized agent to act on your behalf, subject to verification of the agent’s authority. CEF will respond to verifiable consumer requests within the time periods required by the CCPA (generally forty-five (45) days, with one optional forty-five (45) day extension where reasonably necessary).
In the prior twelve (12) months, CEF has collected the categories of Personal Information described in Section 3, has used such Personal Information for the purposes described in Section 5, and has disclosed such Personal Information for business purposes to the categories of recipients described in Section 7. CEF has not sold or shared Personal Information for cross-context behavioral advertising in the prior twelve (12) months.
10. Children’s Privacy
The Site is not directed to children under the age of 13, and CEF does not knowingly collect personal information from children under 13. If you believe that a child under 13 has submitted personal information through the Site, please contact CEF at info@cooperativeenergyfutures.com, and CEF will take steps to delete the information in accordance with the Children’s Online Privacy Protection Act (COPPA) and other applicable laws.
11. Security
CEF maintains administrative, technical, and physical safeguards designed to protect Personal Information against accidental or unlawful loss, unauthorized access, and misuse. No method of transmission or storage is perfectly secure, however, and CEF cannot guarantee absolute security.
12. Changes to This Privacy Policy
CEF may update this Privacy Policy from time to time. When CEF does, CEF will update the “Last Updated” date above and, if the change is material, provide additional notice (for example, by email to visitors who have submitted an email address through the Site, or through a notice on the Site). Your continued use of the Site after the effective date of an updated Privacy Policy constitutes your acceptance of it.
